Terms of Service

1. Agreement to Terms
These Terms of Service (“Terms”) constitute a legally binding agreement between you (“Merchant,” “you,” or “your”) and EditMuse Ltd (“EditMuse,” “we,” “us,” or “our”) governing your use of the EditMuse application and related services (“Service”).
In these Terms, “EditMuse,” “we,” “us,” or “our” means EditMuse Ltd (company number 15604417), registered in England and Wales.
By installing, accessing, or using the Service, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the Service.
2. Eligibility
To use the Service, you must:
- Be at least 18 years of age or the age of majority in your jurisdiction
- Have the authority to bind yourself or your business to these Terms
- Operate a Shopify store in compliance with Shopify's terms of service
- Comply with all applicable laws and regulations
- Use the Service only as a Shopify store owner or someone with authority to act on behalf of the store that installs the app
3. Description of Service
EditMuse provides an AI-powered shopping concierge application for Shopify merchants. The Service enables merchants to create guided product discovery experiences for their customers through conversational AI, hybrid flows, and quiz journeys.
4. Account and Access
Access to EditMuse is provided through the Shopify App Store. You are responsible for:
- Maintaining the security of your Shopify account
- All activities that occur under your account
- Promptly notifying us of any unauthorized access
5. Acceptable Use
You agree not to use the Service to:
- Violate any applicable laws or regulations
- Infringe on intellectual property or privacy rights of others
- Transmit malware, viruses, or harmful code
- Interfere with or disrupt the Service or its infrastructure
- Attempt to gain unauthorized access to any systems
- Use the Service for illegal, fraudulent, or deceptive purposes
- Scrape, crawl, or extract data from the Service for unauthorized purposes
- Resell or sublicense the Service without authorization
6. Merchant Responsibilities
As a merchant using EditMuse, you are responsible for:
- Content: All product data, descriptions, and content displayed through the Service
- Accuracy: Ensuring your product information is accurate and up-to-date
- Compliance: Compliance with consumer protection laws, advertising regulations, and privacy laws applicable to your store and customers
- Customer Relations: All customer service, fulfillment, returns, and disputes with your customers
- Integrations: Proper configuration of any third-party integrations you enable
7. Subscriptions and Billing
7.1 Plans and Pricing
The Service is offered on a subscription basis with various plan tiers as described on our Pricing page. Pricing is subject to change with reasonable notice.
7.2 Billing Through Shopify
All billing is processed through Shopify's app billing system. By subscribing, you authorize Shopify to charge your payment method according to your selected plan and usage.
7.3 Credits and Overage
Paid subscription plans include a monthly credit allowance (and may include add-on credits as described in the app or on our Pricing page). If you exceed your included allowance during a paid subscription, overage may be charged at the rate shown for your plan in Shopify or in the app.
Free trial: If you are on a free trial, usage is subject to the trial limits below. You are not charged EditMuse overage credits during the trial; when trial limits are reached, you must subscribe to a paid plan to continue using the Service beyond those limits.
7.4 Free Trial
New merchants may be eligible for a free trial as described on our Pricing page and in the app. Unless we state otherwise there, the trial includes both (a) a maximum of 7 calendar days from when the trial starts and (b) a maximum of 50 credits of included trial usage. The trial ends when whichever limit you hit first — time or credits. Other trial limits (such as number of experiences or search depth) may apply as shown in the app. Trial eligibility and reuse rules (for example after uninstall and reinstall) are as described in the app or on the Pricing page.
7.5 Cancellation and Uninstall
You may cancel a paid subscription or manage app billing in line with Shopify's app subscription and billing flows (typically through your Shopify admin). How charges work when you cancel or uninstall — including the current billing period — is governed by Shopify's terms and help documentation as well as what you approve in the admin.
Uninstalling the app is separate from changing a plan; it may affect access to the Service and how billing is handled. For what happens to data after uninstall or if you ask us to delete information, see our Privacy Policy.
8. Data and Privacy
Your use of the Service is also governed by our Privacy Policy, which describes how we collect, use, and protect information.
You grant EditMuse a limited license to access and process your product catalog data as necessary to provide the Service.
Retention and deletion: How long we keep information, and how you may request deletion or exercise other rights, is described in our Privacy Policy. If there is any conflict between a short summary in these Terms and the Privacy Policy on data practices, the Privacy Policy prevails.
Artificial intelligence: The Service uses automated and AI-assisted processing to interpret shopper inputs and rank or explain product suggestions. Outputs are recommendations only; you remain responsible for your catalogue, compliance, and how you present products to customers (see sections 6 and 10).
9. Intellectual Property
9.1 Our Intellectual Property
The Service, including its software, design, features, and documentation, is owned by EditMuse and protected by intellectual property laws. You receive a limited, non-exclusive, non-transferable license to use the Service according to these Terms.
9.2 Your Content
You retain ownership of your product data and content. You grant us a license to use this content solely to provide the Service.
9.3 Feedback
If you provide feedback or suggestions about the Service, you grant us the right to use such feedback without obligation to you.
10. Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
We do not warrant that:
- The Service will be uninterrupted, error-free, or secure
- Results obtained from the Service will be accurate or reliable
- The Service will meet your specific requirements
AI-generated recommendations are provided as suggestions only. We do not guarantee any specific business outcomes, sales increases, or conversion rates.
11. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, EDITMUSE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR BUSINESS OPPORTUNITIES, ARISING FROM YOUR USE OF THE SERVICE.
OUR TOTAL LIABILITY FOR ALL CLAIMS ARISING FROM OR RELATED TO THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.
12. Indemnification
You agree to indemnify, defend, and hold harmless EditMuse and its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable legal fees) arising from:
- Your use of the Service
- Your violation of these Terms
- Your violation of any rights of a third party
- Your product data or content
13. Termination
We may suspend or terminate your access to the Service at any time for violation of these Terms or for any other reason with reasonable notice. Upon termination:
- Your license to use the Service ends immediately
- You remain responsible for any outstanding charges
- We may delete your data in accordance with our Privacy Policy
14. Modifications to Service and Terms
We reserve the right to modify the Service or these Terms at any time. We will provide reasonable notice of material changes. Your continued use of the Service after changes take effect constitutes acceptance of the modified Terms.
15. Governing Law and Disputes
These Terms are governed by the laws of England and Wales, without regard to conflict of law principles.
Any disputes arising from these Terms or the Service shall be resolved through binding arbitration or in the courts of England and Wales, at our discretion.
16. General Provisions
- Entire Agreement: These Terms, together with the Privacy Policy, constitute the entire agreement between you and EditMuse.
- Severability: If any provision is found unenforceable, the remaining provisions continue in effect.
- Waiver: Our failure to enforce any right does not waive that right.
- Assignment: You may not assign these Terms without our consent.
